Terms of Service

These terms are an agreement between you and Push Instant Notifications LLC ("we", "us") covering your use of the Event Messages app. By creating an account you accept them.

Your account

You need a working email address and a mobile number you can receive SMS on, because we verify the number before the account can be used. Keep your password to yourself; you are responsible for what is done with your account. Give us accurate information — an account created with someone else's phone number may be removed.

You must be old enough to form a binding contract where you live, and at least 13 in any case.

Paying for an event

Creating an account, browsing events and subscribing are free. Creating an event that can receive updates costs US $89.99, paid once per event as an in-app purchase through the App Store or Google Play.

The payment is taken by Apple or Google under their terms, not by us, and one purchase pays for exactly one event. It is not a subscription, it does not renew, and there is no additional charge for the number of updates you post or the number of people who subscribe.

Because the stores take the payment, they handle refunds too. Ask Apple or Google. If a purchase failed for a technical reason on our side, tell us and we will help.

What you post

You keep ownership of what you write. You give us permission to store it and deliver it to the people subscribed to your event, which is the whole purpose of the service.

You are responsible for your updates. Do not post anything unlawful, threatening, harassing, deceptive, or infringing on someone else's rights, and do not use the app to send unsolicited marketing. Updates cannot be edited or deleted once posted, so consider what you are sending before you send it.

If an organiser grants you writing rights on their event, updates you post there carry your name and reach that event's subscribers.

Notifications

The app delivers notifications through Apple's and Google's push services. We send every notification promptly, but delivery to a particular handset depends on those services, on the device's own settings, and on its connection. Do not rely on this app alone where a missed message would be dangerous. It is a convenience for keeping people informed, not an emergency alerting system.

Availability

We work to keep the service running but do not guarantee it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the service entirely while you hold a paid event that has not yet ended, write to us.

Ending it

You may stop using the app at any time and ask us to delete your account, as described in Support. We may suspend or close an account that breaks these terms or that is being used to harm others.

Disclaimers and liability

The app is provided "as is", without warranties of any kind to the extent the law allows. To the maximum extent permitted by law, our total liability to you for any claim relating to the app is limited to the amount you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws rules.

Changes

We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the app after a change means you accept the updated terms.
